Navigating Visa Strategies: Moving from Subclass 864 to 804

With processing times for Contributory Parent visa applications now stretching to 12+ years, many individuals who have applied for subclass 864 Contributory Aged Parent visas are reevaluating their visa strategy. Some are contemplating withdrawing their current application and opting for a subclass 804 non-Contributory Aged Parent visa instead.


While this may seem like a feasible option, there are crucial practical considerations to keep in mind before making any decisions.


One significant issue to understand is the impact on Bridging Visas and the ability to travel in and out of Australia when transitioning from subclass 864 to 804. If you are currently in Australia holding an active Bridging Visa A when you withdraw your 864 application and apply for an 804 visa, you will no longer hold what is referred to as a "substantive visa" during the processing period of your subclass 804 application.


Consequently, upon receipt of the subclass 804 application, you will be granted a Bridging Visa C. Unfortunately, this means that you won't be able to apply for a Bridging Visa B if you later wish to depart Australia and return. Applications for Bridging Visa B can only be made by those who hold a Bridging Visa A or another Bridging Visa B.
